I realize that the Supremes passed on hearing this case, but I strongly disagree with the decision of the New Jersey Supreme Court… Doesn’t the statute matter?
Does election law matter any longer?. Yesterday the New Jersey Supreme Court decided that a deadline for candidate change and selection in the states election law must be set aside to preserve the concept of a two party system. Essentially the New Jersey Supreme court has allowed the NJ Democratic Party to substitute Frank Lautenberg as the party’s candidate to replace Robert Torricelli on the ballot for one of NJ’s seats in the US Senate well after the statutory deadline has passed.
