It is the particular hell for lawyers that after an argument, we live in the purgatory of constantly reliving the argument. Every night since Wednesday I have awoken in the middle of the night, to spend the rest of the night reanswering Justice Ginsburg, or asking Chief Justice Rehnquist just how he could distingiush Commerce from Copyright. The kind words of so many notwithstanding, I know and have always known I am not Larry Tribe, or Kathleen Sullivan. And if, after getting this so close to the right result, I have lost this by not being them, then I am not quite sure how I will live with that fact.


Larry, be confident of one thing:  you did your duty.  It was the right thing to do.  What more can you can you be expected to do?  This isn’t a one shot deal, this is a multi-generational battle for the heart and soul of ideas.  Nobody expected it to be won in a single shot. I still love the Sopranos.



According to the Times, NYC mayor Bloomberg wanted to march in the Columbus Day parade with two actors from The Sopranos, Uncle Junior and Tony’s psychiatrist. The sponsors of the parade said no, and filed suit against the mayor (only in NY). The mayor withdrew, instead he’s going to have a nice Italian dinner with the two in the Bronx. [Scripting News]

The Rule of Law

Does it exist anymore?


I realize that the Supremes passed on hearing this case, but I strongly disagree with the decision of the New Jersey Supreme Court…  Doesn’t the statute matter?



Does election law matter any longer?. Yesterday the New Jersey Supreme Court decided that a deadline for candidate change and selection in the states election law must be set aside to preserve the concept of a two party system. Essentially the New Jersey Supreme court has allowed the NJ Democratic Party to substitute Frank Lautenberg as the party’s candidate to replace Robert Torricelli on the ballot for one of NJ’s seats in the US Senate well after the statutory deadline has passed. Yeah!

I just spoke to Borders: the 400 stores announced is the entire chain. They have nearly that many now, with over 400 planned to be open by Christmas. The rollout should be done by mid-2003 with a formal announcement at that point, even though service will be available (starting in California) in the meantime.  [80211b News]
